High Court orders suspension of job reinstatement and compensation for Jennifer

The High Court has ordered to suspend the implementation of the Employment Tribunal’s ruling which had determined that Aishath Jenifa’s dismissal from her position as Deputy Managing Director of Island Aviation was unlawful and had ordered her reinstatement.

Jenifa was appointed as the Deputy Managing Director of Island Aviation on December 18 during former President Ibrahim Mohamed Solih’s administration. She was dismissed from her position during a board meeting in January of this year.

Consequently, Jenifa filed a case with the Employment Tribunal. In its ruling on October 13, the Tribunal stated that Jenifa was dismissed without a justifiable cause for termination. The ruling also stated that her dismissal was carried out without establishing substantive and procedural fairness.

Therefore, the Tribunal ordered Jenifa’s reinstatement and payment of salary and benefits for the period from her dismissal date to the date of the case conclusion. The Tribunal also ordered payment of 56,171 rufiyaa, equivalent to one month’s salary and benefits, as compensation for unfair dismissal, to be paid within 30 days from the ruling date.

In the order issued yesterday, the High Court stated that the implementation of the Employment Tribunal’s decision should be suspended until the appeal case is reviewed and decided, or until further notice.
